Summary: The proposed amendments to the Housing Division Rules bring the rules up to date with legislation enacted since they were last updated on January 1, 2008; including Act 176 of 2008, Act 140 of 2010, and Act 137 of 2012, and update the name of the department. Part I is amended for: requirements for admission and selling or renting mobile homes, providing or renewing leases; increased notice before park closure, requiring a notice of intent to sell before closing a park, park sale negotiation period, clarifying when sale notices expire; limits on rent increases when closing a park; aligning definitions with statute and correct use of the terms leaseholder, resident or mobile home owner; evictions for criminal activity; description of good faith, and expiration of sale notices. Part II is amended for: eligibility requirements for mediators; requiring mediators to accept the fee schedule and submit invoices within 90 days.
Persons Affected: Mobile home park residents and owners, mediators interested in being on the department's roster for lot rent disputes.
Economic Impact: No additional costs than imposed by the underlying statute. When closing a park, no lot rent increases will be allowed unless necessary to address urgent habitability problems. Park owners who close a park within a year of receiving notice of a health, safety or environmental violation may be required by the Commissioner to pay $3,500 relocation costs to each leaseholder unless they have no ability to comply. Park owners who close a park and sell the land within 5 years without first giving a sale notice may be fined up to $10,000 or 50 of the gain on the sale unless the Commissioner grant them relief. Mobile home park owners may incur slightly higher costs to mail park sale notices return receip
