Summary: Act 62 responded to a Vermont business changing its LED sign every few seconds. The council must adopt rules on what constitutes flashing intermittent or moving lights or animated or moving parts within the meaning of 10 V.S.A. § 495(a)(3). The council must consider reliable empirical studies of the effect of changing or flashing signs on traffic safety; the current state of sign technology and expected future developments in sign technology; and the findings set forth in 10 V.S.A. § 482 concerning the value of the scenic resources of the state, the importance of providing information regarding services, accommodations, and points of interest to the traveling public, and the hazard created by the proliferation of outdoor advertising.
Persons Affected: Any person having or desiring an on-premise sign that can change its display by way of lighting or movement; The agency of transportation; The agency of commerce and community development (specifically the Department of Tourism and Marketing); Municipalities (Vermont League of Cities and Towns); Regional Planning Commissions; Regional Development Corporations; Vermont Chamber of Commerce, and other business organizations; Vermont Natural Resources Council, and other environmental organizations; Market participants from all stages of the sign industry; The general public; and Visitors to Vermont.
Economic Impact: Signs that are manufactured with the ability to change by way of lighting or movement are more expensive than static signs made from traditional materials, with the exception of a sign having an extraordinarily creative design. At present, very few signs in Vermont have intermittent displays. Therefore, not enough evidence exists to suggest the economic impact would be anything other than neutral.
