This Rule establishes the framework (policy, administration, schedule of penalties) for the issuance of citations to resolve environmental violations of the statute (10 V.S.A. Ch. 151), the Act 250 Rules, and Land Use Permits under the jurisdiction of the Natural Resources Board.
Vermont Agency of Natural Resources, Public and private entities who violate Act 250, the Act 250 Rules, or Land Use Permits and those affected by such violations.
Although the issuance of a citation to a person who violates Act 250, the Act 250 Rules, or an Act 250 Land Use Permit will obviously have negative impacts on such person, the legislature, through the adoption of 10 V.S.A. Chapters 201 and 210, has expressed an intent that such violations are to be addressed and resolved. The issuance of a citation for Act 250 violations to such person should have positive effects on other people who might themselves contemplate violating Vermont's environmental laws, and on others who might be harmed, either environmentally or economically, by such violations.
