Summary: This amendment to the Employment Security Board Rules implements provisions of recent legislation regarding unemployment insurance; specifically, unemployment benefit overpayments. The amended rule adds a procedure to apply for waiver of repayment of overpaid unemployment benefits where the individual is not at fault for the overpayment, and where ordering repayment would be contrary to equity and good conscience. The amended rule adds definitions for "fault" and "contrary to equity and good conscience" and outlines the application process; notice requirements; determinations on applications; and appellate procedure.
