Summary: The major change to the rules is the elimination of the committee system for review and service determination. The current Attendant Services Program (ASP) regulations refer to regional committees that determine eligibility for an applicant in the region in which they reside. Regional Committees have not been in place or used for the last 12 - 15 years. The Statewide Eligibility Committee has served that function. The purpose of having a local peer group to determine an individual's needs in the absence of others will expertise is no longer necessary. Elimination of the regional and state wide committee system will result in a more streamlined, cost-effective determination of each participant's needs. For the past 3 years the Department's staff (RNs) served this function. The intent is to align the ASP eligibility process to that of other long-term care programs by using state assessors to establish eligibility and service needs. Other rule changes were made for clarity in definitions and intent.
Persons Affected: The ASP program participants, the ASP Eligibility Committee, the Department of Disabilities, Aging and Independent Living.
Economic Impact: The proposed changes in the regulations will afford a more cost-effective review system for the program, will eliminate the 'guess-work' and inconsistency of the committee system and will allow individuals to access services in a more timely manner. Currently it is a 3 - 4 month process from the time of application to the final award. The system change will allow that time to be cut at least in half.
