Summary: The rule proposes to list the Appalachian Sandcherry, the White camas, the Common nighthawk, and the Tri-colored bat as Endangered and the Whip-poor-will as Threatened. The rule proposes to de-list the Sandberg's birch. Lastly, the rule proposes to de-list the Western chorus frog and list the Boreal chorus frog, the Western chorus frog having been misidentified when it was first listed. The rule has also been re-drafted to provide clarity, consistency and predictability for the permit process. The emendations include excising provisions already found in statute and more clearly describing an applicant's obligations when applying for a permit. Lastly, the rule includes a mitigation analysis that has been used in practice but it is proper to have in the rule itself.
Persons Affected: Agency personnel, a small number of landowners, perhaps some homebuilders.
Economic Impact: White camas: There will be no economic impact as the only population occurs on state-owned land. Susquehanna sand cherry: Any economic impact would be restricted to the single privatley owned location although the landowners have been voluntarily protecting it for a number of years. Whip-poor-will and Common nighthawk: Economic impacts would be likely be scattered and minimal. They would likely be focused in the Champlain and Connecticut River Valleys. Avoidance might consist of retaining core habitat areas of known nest sites. Tri-colored bat: There will be no economic impacts.
