| Summary: | The proposed rule on the use of restraint and seclusion would severely limit the use of restraint and/or seclusion in schools. Mechanical, chemical, supine physical, prone physical and any restraint that restricts breathing will be prohibited. Restraint and seclusion may be used only when a student's behavior poses imminent and substantial risk of physical harm and when less restrictive interventions would be ineffective. Restraint and seclusion shall be imposed only by staff trained in the proper use of such restraint or seclusion. The use of physical restraint or seclusion must be reported to the site administrator and to the parents and in some instances to the superintendent and department of education. |
| Persons Affected: | Public and independent schools that receive public funds as well as the staff and students at those schools will be affected by this rule. |
| Economic Impact: | There will be some minor cost implications to schools/districts for staff training. |
