Summary: The definition of Self Support Reserve in 15 V.S.A. § 653(7) was amended effective July 1, 2012. This rule states the way the Self Support Reserve is calculated in order to comport with the statutory changes. The revision also provides for use of the updated Self Support Reserve beginning three weeks after the publication of the updated poverty guideline in the Federal Register.
Persons Affected: Children of separated parents; custodial parents; non-custodial parents; Family Court Case Managers; Judges and Magistrates; Office of Child Support staff; and attorneys representing parties in child support cases.
Economic Impact: Parents and children, who are recipients and payers of child support, will be directly affected by the change in the Self Support Reserve. Specifically affected are parties and children in cases where the non-custodial parent's monthly available income is lowered by the increase in the Self Support Reserve and where that figure is less than the parental support obligation. This yields a lower guideline calculation. Parents and children will benefit from this change making child support obligations more realistic and more likely to be paid. The brief response period for the Office of Child Support (OCS) to make the change to the Self Support Reserve will result in a potential cost to non-custodial parents in limited circumstances.
