Summary: This rule is designed to establish standards that will ensure that emergency involuntary procedures (seclusion, restraint and emergency involuntary medication) in hospital psychiatric units and in the secure residential recovery facility are used only in emergency situations in accordance with generally accepted professional standards of care and the standards established in this rule. The rule sets forth definitions of emergency involuntary procedures and sets standards for the assessment process, the writing of orders, limitations on the use of the procedures, and documentation and reporting requirements when the emergency involuntary procedures are used. The rule also establishes an advisory panel to review aggregate data about the use of emergency involuntary procedures and to respond to individual patient complaints.
Persons Affected: The Commissioner and staff of the Department of Mental Health; individuals in the care and custody of the Commissioner; administrators and staff of psychiatric units in Vermont in which there are individuals in the custody of the Commissioner of Mental Health, including the designated hospitals and the secure residential recovery facility.
Economic Impact: The rule will have an impact on hospitals that provide psychiatric care to persons in the custody of the Commissioner of Mental Health. There will be increased costs to hospitals that do not have physicians or licensed independent practitioners (such as advanced practice registered nurses or physician assistants) on duty around the clock. Any such additional costs to the hospitals will need to be covered by state Medicaid reimbursements as "reasonable actual" costs.
