Summary: This proposed rule changes the rate setting methodology for private nonmedical institutions providing residential child care services (PNMI) from a budget-based system to a prospective rate setting system based on allowable actual costs in a base year. The last time that the Division of Rate Setting (Division) set rates for PNMIs was in state fiscal year 2008. In state fiscal year 2009, PNMIs received a 3.75 percent increase through the rulemaking process and the intent was to adopt a new rate setting methodology to set rates for state fiscal year 2010. However, beginning in state fiscal year 2010, PNMIs have been level-funded every year until now. In Act 50 of the 2013-2014 legislative session, language was included that level-funded PNMIs for the first quarter of state fiscal year 2014, but that also directed the Division to propose a rule to set rates based on actual costs effective October 1, 2013.
Persons Affected: The rule will affect the federal government, State of Vermont and residential treatment programs participating in the Medicaid program. This rule is not expected to have any direct effect on residents of the residential treatment programs.
Economic Impact: The estimated economic impact of this rule is an increased spending in state fiscal year 2014 of $450,000 as a result of transitioning from the current cost structure of the PNMI programs to base year 2012 actual costs and occupancy data. After that, a new base year will be selected every state fiscal year and programs' rates will be based on allowable costs in the base year. As the future base year costs are not yet known, it is impossible to estimate spending beyond that in state fiscal year 2014. However, programs' per diem rates will be capped from year to year by a weighted inflation factor, which helps the State to control unanticipated and unapproved increased spending.
