Summary: Act 148 passed in 2012 (the "Universal Recycling Law") seeks to improve the capture and diversion rates for valuable materials (such as recyclables, clean wood, leaf & yard debris, and food scraps) to prevent them from being landfilled. This rule amends the previous solid waste management plan which was readopted in 2006. The rule includes significant changes to the structure and layout of the plan. This rule is based on five material specific chapters and a chapter addressing general planning needs. Each chapter contains tools of action, state goals, and performance standards. The state goals, and performance standards establish deliverables for the planning period that include reporting, outreach and education, and convenience requirements. This rule includes revisions that incorporate recommendations from an ANR solid waste stakeholder group that convened in 2008.
Persons Affected: Solid waste management entities (districts, alliances, and independent municipalities); Agency of Agriculture Food and Markets; Department of Health (Food and Lodging); Buildings and General Services; Agency of Transportation; Agency of Education; environmental and conservation organizations; generators of waste and households; recycling and materials recovery facilities; commercial solid waste haulers, transfer stations, and landfill owners; and facilities managing household hazardous waste and universal waste. Note that Act 148 will affect all state entities in some fashion as it is related to how recyclable and compostable materials are managed in Vermont. This proposed rule will have the greatest effect on government entities with regulatory oversight of health, management of organic residuals, and infrastructure improvements for public spaces across the state.
Economic Impact: This rule and Act 148 will affect all Vermonters engaged in management of discarded materials. This rule specifically includes solid waste management entities (districts, groups, alliances, and independent towns) and indirectly includes other managing solid waste, such as hauling companies, municipal solid waste facilities, individuals, corporations, municipalities, non-profits, and farmers. It is estimated that full implementation of Act 148 will cost up to $15 million per year over the course of nine years. Of these costs, capital costs are estimated to be approximately $4.1 million per year and the remaining are operating costs. This averages out to be an estimated $5 monthly increase per household, and an $18 per ton increase for the institutional, commercial, and industrial sector (ICI). The estimated monthly cost increases per household, and per ton for the ICI sector, were calculated by considering the total expense for Act 148 implementation over nine years and allocated by generation rate.
