Summary: The current regulations have been in effect since October 1996. Since 1996, many changes affecting school age programs have occurred. These include changes in legislation affecting 21st Century programs (administered through the Agency of Education), the reorganization of the department responsible to regulating and monitoring child care programs, the system of early childhood and afterschool services in Vermont, emerging technologies and new information on how programs can most effectively support children's growth and development. This revision provides clarification and incorporates new information to update definitions, staff qualifications, effective program operation and changes in both program and regulatory practice. The rules have been reorganized to regulatory practice. The rules have been reorganized to make the document more user-friendly for both programs and licensing staff. These regulations promote a balance between what is best for the safety and well-being of children and the practical day-to-day demands of operating a child care program.
Persons Affected: All afterschool programs not exempt from regulation including private for-profit and non-profit community based programs; Local education agencies that operate afterschool programs after school hours or provide or lease space for other entities to provide afterschool services in school buildings; Department for Children and Families and Department of Health in the Vermont Agency of Human Services; Division of Fire Safety in the Vermont Department of Public Safety; Department of Environmental Conservation in the Vermont Agency of Natural Resources; Insurance carriers for afterschool child care providers; and School aged children and their families.
Economic Impact: Quality afterschool care is a critical support for many families in the workforce across Vermont. There are 143 licensed afterschool programs in Vermont serving up to 8,913 kindergarten children through age 13 per day, as well as children over 13 years of age receiving special education services. The operation of an afterschool program requires an investment in space, equipment, materials and staffing. Some required inspections have a cost as does insurance and the ongoing professional development of staff. These costs will not be significantly impacted by the changes proposed in this revision.
