Summary: This emergency rule amends previously filed Health Benefits Eligibility and Enrollment (HBEE) Amendment #2, and emergency rule adopted January 1, 2014, to incorporate federal guidance issued too late to include in HBEE amendment #2. This rule also makes clarifications, changes and technical corrections to HBEE Amendment #2.
Persons Affected: Medicaid applicants and enrollees; Individuals who lack access to government-sponsored minimum essential coverage and who wish to purchase health coverage; Small employers who wish to offer health coverage to their employees; Employees of small businesses; Health insurance issuers; Health insurance brokers; Health care providers; Health law, policy and related advocacy and community-based organizations and groups; Office of Health Care Advocate; Agency of Human Services (including Department for Children and Families, Department of Vermont Health Access, Department of Disabilities, Aging and Independent Living, Department of Health and Department of Mental Health; and Department of Financial Regulation.
Economic Impact: Vermont received federal grants to establish and operate its "exchange," Vermont Health Connect (VHC), through calendar year 2014. The State is providing $4.3 million in state fiscal year (SFY) 2014 for premium subsidies and cost-sharing assistance starting on January 1, 2014. The $4.3 million is funded through savings from the discontinuation of the Vermont Health Access Plan (VHAP) and the Catamount Health Plan programs. In SFY 2014, the State is anticipating spending $9/1 million for premium subsidies and cost-sharing assistance which will be funded through savings from the discontinuation of VHAP and the Catamount Health Plan programs. The full operational costs of VHC will become the responsibility of the State on January 1, 2015. The State estimates that in SFY 2014 this cost will be $5.3 million which will represent a new net cost to the State.
