| Summary:
| This Rule clarifies the technology-based and water quality-based requirements applicable to the remaining combined sewer overflows (CSOs) within the State, consistent with existing federal law and the Vermont Water Quality Standards (VWQS). Further, this Rule lays out the existing permits, tools, and processes the Agency will utilize to require municipalities to bring CSOs into compliance with federal and state law. For background information: Combined sewer systems collect both sewage and stormwater in the same pipe. These systems were designed to have overflow points to direct excess flow out of the system during intense precipitation events to prevent the overwhelming of the treatment plant, backups into basements, and street flooding from surcharging manholes. This discharge of untreated wastewater under wet weather conditions can adversely affect the quality of waters of the State and may create short-term public health concerns. |

| Economic Impact:
| Consistent with existing state and federal law, this Rule clarifies the technology-based and water quality-based requirements applicable to CSOs and lays out the existing permits, tools, and processes by which the State will require municipalities to bring CSOs into compliance with state law, including the VWQS. This Rule does not impose additional costs, since the State and municipalities already have an obligation to bring such discharges into compliance. The Agency has included an estimate of the costs of bringing the remaining 68 CSOs into compliance for informational purposes. |
