Summary: This is an update of the existing Underground Storage Tank Rules (effective October 13, 2018). These rules mirror Federal regulations and are a major factor in EPA's delegation of the program to the State. The rule regulates the installation and operation of underground storage tank systems that store gasoline, diesel fuel, heating oil, kerosene, used oil, and other hazardous materials. These materials have great potential to affect human health and the environment, and the rules serve to minimize the potential threat from the underground storage tank systems. The 2020 changes will not include any new requirements that tank owners and operators must deal with, but will streamline requirements making it easier for the regulated community to comply when a facility changes ownership or important repairs are needed.
Persons Affected: Underground storage tank owners and operators at commercial facilities (gas stations, mini marts, trucking depots, marinas etc.) are affected by this rule. In addition, municipalities, some state government agencies (Buildings & General Services, Agency of Transportation), and a small number of school systems are affected, since these entities may own underground tanks.
Economic Impact: The 2020 amendments to the UST rules will result in no additional costs to facility owners, and in many cases, the proposed rule amendments will reduce costs. When the new rule is implemented, the Agency will be able to transfer a permit to a new owner without posting a draft permit on the ENB for 14 days, allowing new owners to sell fuel immediately upon purchase of the store. Underground storage tank permittees will have to test containment sumps, spill buckets, and overfill devices by September 1, 2020. The proposed rule will allow tank owners to make repairs immediately when a component fails, rather than waiting while a construction permit is on the ENB.
