Summary: The Attorney General's office proposed to revise CF 111, to incorporate amendments to the enabling legislation enacted may 26, 2011 by the Vermont Energy Act of 2011 (Act 47 of 2011). CF 111 was first promulgated in 1986 and revised in 2009. This revision brings the rule into compliance with enabling legislation changes, reorganized the rule for easier use and access by sellers and consumers based on the flow of their relationship and provides definitions and clarity to terms and procedures that most recently created confusion.
Persons Affected: Approximately 140,000 Vermont consumers of propane and approximately 75 propane sellers, both in and out of state are affected by this rule. Notice of the proposed rule revisions have been sent to the Agency of Human Services which runs Vermont's Low Income Home Energy Assistance Program (LIHEAP), the Department of Public Service, the Department of Public Safety, the Vermont Fuel Dealers Association, and Community Action Agencies in Vermont.
Economic Impact: The Attorney General's office has worked closely with the Vermont Fuel Dealers Association to ensure that the proposed rule revisions are reasonable, so their economic impact is expected to be limited. The main economic impact for sellers has already been absorbed upon the enactment of the amendment to the enabling legislation. Added revisions clarify terms and procedures that created confusion and should save sellers and consumers time and money. Clarified written notice requirements may have a modest cost impact, but are already standard practice for the majority of sellers.
