Summary: The WWPWS Rules were updated and became effective April 12, 2019. There is one important unintended change in the 2019 Rules from a requirement in the 2007 Rules for siting wastewater systems. The 2007 Rules allowed 18 inches to bedrock for certain wastewater systems, the 2019 Rules inadvertently requires 24 inches to bedrock for the same systems. Other changes include information to be included with applications for innovative/alternative products, exempting composting and incinerator toilets for State owned remote campsites, clarify when a permit is needed to install a composting or incinerator toilet, allow pre-2007 soil analysis, remove references to the percolation test, clarify and simplify design requirements for water/sewer crossovers, expand the cost considerations in the variance section, and statutory changes for holding tanks. We also made minor changes for clarity and some typographical errors.
Persons Affected: Many Vermonters will be affected by the change to the soil requirements to site wastewater systems and will benefit from this rule amendment. Landowners who construct or modify buildings for residences, businesses, or recreation that utilize soil-based wastewater systems or install sewer/water piping may benefit from the availability of expanded options for the design of wastewater systems and more predictable technical and permitting requirements.
Economic Impact: The update and clarification of technical standards for wastewater systems will lead to reduced costs for the design of wastewater systems or water supplies. Without this change to maintain the 18 inches of naturally occurring soil over bedrock in the 2007 Rules, landowners will need to have pretreatment units to treat the wastewater to filtrate quality when the site has less than 24 inches of naturally occurring soil to bedrock. The initial pretreatment unit may cost $8,000.00 or more with additional costs for annual inspection. Eliminating the percolation test will have no impact on costs. Changes to the requirements for sewer/water crossovers may decrease construction costs by eliminating sleeving entire sections of piping and only require sleeving pipe joints. Allowing pre-2007 soil reports to design leachfields may eliminate costs to re-evaulate soil.
